In a condominium complex,\u00a0ownership responsibilities belong to you and all the\u00a0other unit owners in your condominium corporation.<br \/>\nSome examples of residential condominiums are an\u00a0apartment within an apartment building, a duplex, a\u00a0bungalow, or a townhouse.\u00a0Non-residential condominiums may be commercial\u00a0outlets, resorts, time shares, and bare land units.<br \/>\n<strong>Condominium Unit<\/strong><br \/>\n<a href=\"https:\/\/auburnbaysetonhomes.com\/wp-content\/uploads\/2013\/10\/Condo-Plan-1-.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-906 size-full\" src=\"https:\/\/auburnbaysetonhomes.com\/wp-content\/uploads\/2013\/10\/Condo-Plan-1-.jpg\" alt=\"Condo Plan townhomes for sale\" width=\"277\" height=\"182\" title=\"\"><\/a>The exact boundaries of each condominium unit are\u00a0identified in a condominium plan.\u00a0When you buy a unit you acquire title to a space\u00a0that is usually bound by walls, floors, and ceilings.<br \/>\nYou are responsible for the maintenance, repair \u00a0and\u00a0remodeling of your unit. However, you may need\u00a0the board\u2019s permission to remodel your unit if the\u00a0changes impact the common property.<br \/>\n<strong>Bare Land Units<\/strong><br \/>\nIn a bare land unit, you buy the actual land and\u00a0anything built on it. Usually the exterior walls, the\u00a0roof, the foundation, driveway and at least part of the\u00a0landscaping are part of the condominium unit and\u00a0must be repaired and maintained by the individual\u00a0unit owner. However, the exterior repair and\u00a0maintenance obligations of the individual bare land\u00a0unit owners may be transferred to the condominium\u00a0corporation through the registration of properly\u00a0worded bylaws.<\/p>\n<p><strong>Common Property<\/strong><br \/>\nThe common property in a condominium complex\u00a0is everything that is not within a unit identified in the\u00a0condominium plan. It usually includes the space and\u00a0facilities outside the condominium units, such as\u00a0hallways, elevators, heating and electrical systems,\u00a0laundry rooms, recreation rooms, and landscaped\u00a0areas. In the case of a bare land condominium this\u00a0would include such things as roads. The developer\u00a0assigns a unit factor to every condominium unit when\u00a0registering the condominium plan. The sum total of\u00a0the unit factors for all the units in a condominium\u00a0plan is 10,000. Developers must disclose how they\u00a0set the unit factor. It is important to know the unit\u00a0factor assigned to your unit because it will affect your\u00a0condominium contributions and your voting rights.<\/p>\n<p><a href=\"https:\/\/auburnbaysetonhomes.com\/wp-content\/uploads\/2013\/10\/Exclusive-use-Sign.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft wp-image-910 size-full\" src=\"https:\/\/auburnbaysetonhomes.com\/wp-content\/uploads\/2013\/10\/Exclusive-use-Sign.jpg\" alt=\"Exclusive Use Parking Sign townhomes for sale\" width=\"180\" height=\"135\" title=\"\"><\/a><strong>Exclusive-use common property<\/strong><br \/>\nYou may also lease or have the right to use defined\u00a0areas of the common property called exclusive-use\u00a0areas with private access and use of, (i.e. the carport,\u00a0parking stall or balcony next to the unit). These areas<br \/>\nmay be identified on the condominium plan or defined\u00a0in the corporation\u2019s bylaws. The corporation retains\u00a0the control of these areas.<\/p>\n<p>Check the bylaws to see what exclusive-use areas\u00a0you can access and what your responsibilities are for\u00a0those areas (e.g. maintenance). The condominium\u00a0corporation consists of the owners of all the units\u00a0identified in the condominium plan.<br \/>\nAs a legal entity it can sue for damages to the\u00a0common property and it can be sued regarding any\u00a0matter for which the owners are jointly liable. An\u00a0agent or employee of the corporation can act on\u00a0behalf of the corporation. \u00a0Bylaws regulate the corporation. They provide for\u00a0the control, management and administration of the\u00a0units, the common property and any other real and\u00a0personal property owned by the corporation. A board\u00a0of directors is elected by the unit owners to carry out\u00a0the condominium corporation\u2019s responsibilities\u00a0Condominium bylaws vary greatly. Some for\u00a0example, may not allow children or pets to live in the\u00a0complex. Such as townhomes for sale. In other complexes if you wish to remodel\u00a0the interior of your unit you may have to seek\u00a0approval from the board of directors if the common\u00a0property or building structure is affected. When a\u00a0condominium plan is registered, it may include the\u00a0initial set of bylaws that govern the corporation. If not,\u00a0the bylaws found in Appendix 1 of the Condominium\u00a0Property Act apply until they are replaced. If the\u00a0condominium was built before May 16, 1978, the\u00a0corporation would be regulated by the bylaws found\u00a0in Appendix 2 of the Act until they are replaced.<br \/>\nOwners can change the bylaws to suit their particular\u00a0complex by passing a motion to adopt the changes.<\/p>\n<p>A special resolution, requiring the approval of 75% of\u00a0<span style=\"font-size: 0.95em; line-height: 1.6em;\">the owners named on the unit titles and representing\u00a0<\/span>not less than 7,500 unit factors is required to make\u00a0any changes to the bylaws.
